Trademark Ex Parte Appeal

Trademark applicants who have received a final refusal may appeal to the Trademark Trial and Appeal Board. The appeals process involves submission of evidence and briefs in favor of registration of the trademark which is then reviewed by a 3-judge TTAB panel.  The TTAB can either choose to overturn the Examining Attorney’s refusal to register the trademark or uphold the refusal.
